These Terms of Service ("Terms") govern your use of TradeOps. By creating an account or using the Service you agree to these Terms.
1. The agreement
This is a legal agreement between you (the "User") and TradeOps. If you don't agree to these Terms, don't use the Service. If you're using TradeOps on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. Your account
- You must provide accurate, current information when creating an account.
- You're responsible for safeguarding your password and for everything that happens under your account.
- You must notify us promptly at hello@tradeops.nz if you suspect unauthorised use of your account.
- You must be at least 16 years old to use TradeOps.
3. Subscription and payment
- TradeOps offers a 14-day free trial. No payment is required to start.
- After the trial, the Service is offered as a paid subscription at NZ$10 per week or NZ$40 per month. Prices are inclusive of GST where applicable.
- If you provide a card during the trial, the subscription will automatically begin at the end of the trial. We'll email you before the trial ends.
- Payments are processed by Stripe. By providing card details, you authorise us (via Stripe) to charge your card on the recurring schedule you selected until you cancel.
- If a payment fails, we may retry the charge and the Service may be paused until payment succeeds.
4. Cancellation and refunds
- You can cancel any time from inside the app (Profile → Subscription → Cancel) or by emailing hello@tradeops.nz.
- When you cancel, your access continues until the end of the current billing period — no further charges are made.
- We do not offer refunds for partial periods. If you believe you've been charged in error, contact us within 30 days and we'll investigate in good faith.
- Your data is retained for 90 days after cancellation in case you reactivate, then permanently deleted (subject to legal retention obligations).
5. Acceptable use
You agree not to:
- Use TradeOps for any illegal purpose or in breach of New Zealand law.
- Send spam, harass, or misuse the customer email functionality to contact people who haven't consented.
- Attempt to reverse engineer, decompile, or otherwise extract the source code of the Service.
- Use the Service to store sensitive payment card data, personal health information, or any information you don't have lawful authority to process.
- Resell, lease or sublicense access to TradeOps without our written permission.
- Disrupt or compromise the security or integrity of the Service.
We reserve the right to suspend or terminate accounts that breach these rules.
6. Your content
You retain ownership of all the content you put into TradeOps (client lists, jobs, invoices, photos, etc.). You grant us a limited licence to host, process and display this content solely to provide the Service to you.
You're responsible for ensuring you have the right to upload any content (including any photos or details about your clients) and for complying with the New Zealand Privacy Act 2020 in your handling of client information.
7. Service availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may perform maintenance, upgrades or fixes that briefly interrupt access. We are not liable for losses caused by Service unavailability.
8. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available", without warranties of any kind.
- Our total liability arising out of or relating to these Terms (including the Service) is limited to the amount you have paid to us in the 12 months preceding the event giving rise to the claim, or NZ$100, whichever is greater.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill or business opportunities.
Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 to the extent it applies, or any other statutory right that cannot be excluded.
9. Termination
You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, if your payment fails, or if we are required to do so by law. On termination, your right to use the Service immediately ends.
10. Governing law
These Terms are governed by New Zealand law. Any disputes will be resolved in the courts of New Zealand. Before formal proceedings, we encourage you to contact us first at hello@tradeops.nz so we can try to resolve the issue.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via email or in the app at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the new Terms.
